By accessing or using the Site, submitting a vehicle for review, requesting an offer, communicating with RetireCar, or proceeding with a transaction, you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, do not use the Site.

RetireCar operates as a marketplace and intermediary between vehicle sellers and third-party buyers or service providers. RetireCar is not the purchaser of every vehicle and does not guarantee that a particular buyer will make an offer, complete a purchase, or perform on any specific timeline unless expressly stated in writing.

We may collect seller information, evaluate vehicle details, solicit buyer interest, and present one or more offers or estimated ranges. Any ultimate sale may be completed by RetireCar or by an independent buyer in our network.

You may use the Site only if you are at least 18 years old and able to enter into a binding contract under applicable law.

Any offer, quote, or estimated range depends on the accuracy and completeness of the information you provide. Offers may be revised, withdrawn, or cancelled if there is a data entry issue, title problem, undisclosed damage, missing parts, changed condition, or any other material discrepancy discovered before pickup or transfer.

RetireCar does not guarantee the highest available offer, uninterrupted buyer demand, or a completed sale. Offer availability, pickup timing, and final pricing may vary by location, title status, vehicle condition, and buyer participation.

You represent and warrant that:

• You have authority to submit the vehicle and related information.
• The information you provide is truthful, current, accurate, and complete.
• You will disclose title issues, liens, damage, missing parts, and material defects.
• The vehicle identification information has not been altered or misrepresented.
• You will remove personal belongings before pickup or transfer.

If your information is shared with a buyer, tower, transporter, title vendor, or other service provider, that party may have its own terms, privacy practices, inspection process, and operational requirements. RetireCar is not responsible for the acts, omissions, representations, scheduling delays, or business decisions of independent third parties.

By providing contact information and using the Site, you agree that RetireCar and the parties helping administer your request may contact you by phone, text message, and email about your vehicle, your offer request, transaction updates, support, and where permitted, marketing. You may not use the Site to:

• Submit false, fraudulent, misleading, or infringing information.
• Interfere with the Site, bypass security, scrape data, or use automation without permission.
• Use the Site in violation of any law, regulation, or third-party right.

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RETIRECAR AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF BUSINESS, OR VEHICLE VALUE DISPUTES ARISING OUT OF OR RELATED TO THE SITE, THE SERVICES, OR ANY TRANSACTION WITH AN INDEPENDENT BUYER OR SERVICE PROVIDER.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RETIRECAR'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

You agree to defend, indemnify, and hold harmless RetireCar and its affiliates, owners, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, and expenses, including reasonable attorneys' fees, arising out of your use of the Site, your submitted information, your violation of these Terms, or your violation of any law or third-party right.

We may update these Terms from time to time by posting a revised version on the Site. Your continued use of the Site after the effective date of an update constitutes acceptance of the revised Terms.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
